Se revocó el auto proferido por el Juzgado de la referencia que declaró la nulidad de la admisión de tutela solicitada por la Personera Municipal, toda vez que tiene las facultades para iniciar acción de tutela a nombre de cualquier persona que lo solicite o se encuentre en estado de indefensión, cumpliendo con el mandato contenido en el Art. 49 del Decreto 2591 de 1991.
En consecuencia, la Corte ordenó devolver el expediente al mencionado Juzgado para que se pronuncie sobre el proceso, conforme a lo expuesto en esta providencia.

- R E S U E L V E :
- Primero. REVOCAR el auto de marzo cuatro (4) de mil novecientos noventa y seis (1996) proferido por el Juzgado Promiscuo Municipal de Cucutilla Norte de Santander, que declaró la nulidad de la admisión de tutela solicitada por la señora Blanca Nubia Ortiz Ramírez, Personera Municipal de Cucutilla, por las razones expuestas en este auto.
- Segundo. ORDENAR que por la Secretaría General de la Corte Constitucional, se devuelva el expediente al Juzgado Promiscuo Municipal de Cucutilla, para que se pronuncie sobre el proceso, conforme a lo expuesto en esta providencia.
- Tercero. COMUNICAR a través de la Secretaría General de la Corte Constitucional el contenido de este auto al Juzgado Promiscuo Municipal de Cucutilla, Norte de Santander y a la peticionaria de la presente tutela.
